LP 48: Occupancy Conditions.

1. Applications for the removal of occupancy conditions will be permitted where it can be demonstrated that:

  • there is no longer a need for accommodation in association with a rural business at that site or in the local area (within a 15-20 minute car journey); and,
  • it can be demonstrated that the business operation at that site is no longer financially viable; and,
  • the property has been marketed for sale or rent for a reasonable period (at least 1 year) at a price or rental level which reflects the existence of the occupancy condition.
