LP 59: Development of Land Potentially Affected by Contamination.

1. Development proposals on, or near sites which are known, or are suspected to be, potentially contaminated, or proposals for sensitive land uses, will be supported where it can be demonstrated that they will not expose people, the natural environment, property, water bodies, or other receptors(100) to levels of potential contamination which give rise to unacceptable risks or harm to health or other adverse impacts.

2. Applicants will be required to submit details of:

  • the extent, scale and nature of the potential contamination;
  • an assessment of potential risks to human health, property, nature conservation, water quality or other receptors; and,
  • any preventative, mitigation or remedial measures and supporting assessments.

3. Development proposals will not be supported where they would spread existing contamination, or cause contamination of land.
