I1A Planning Obligations

In appropriate circumstances and prior to the grant of planning permission, the Council will negotiate with developers to enter into a legal obligation to:

  • restrict development or use of land;
  • require works, operations or activities to be carried out;
  • require land or buildings to be used in a specific way;
  • require payments to be made, or financial contributions;
  • require land to be provided;
  • secure the provision of improvements, supporting and mitigating works or measures, compensatory facilities or actions, and community benefits which have been identified and relate to the proposed development; and
  • set out the required timetable/phasing for any of the above.

Such planning obligations will be secured under Section 106 of the Town and Country Planning Act 1990 as amended by the Planning and Compensation Act 1991 or their replacements, and the current relevant circular.
