MIN12 Proposals for Extraction of Clay or Brickearth
Where applications are received to extract clay or brickearth for civil engineering works and borrow pits, the mineral planning authority will have regard to the following criteria:
- The importance of the project, the demonstrated need for the materials and lack of suitable alternative resources or design solutions within the necessary timescale;
- The adequacy of the applicants’ proposals for limiting the overall timescale of the operation, together with environmentally acceptable proposals for extraction, landfilling (where necessary), restoration and aftercare of the site and how the applicant will manage the site during each phase;
- The retention on site of all brickearth topsoils and subsoils for use in restoration.
