P38 Shops outside protected shopping frontages, town and local centres

Development must not result in the loss of shops outside Protected Shopping Frontages, Town and Local Centres. In exceptional circumstances a change may be permitted where:

  • There is no market demand for the shop use. This must be demonstrated by a marketing exercise for two years, immediately prior to any planning application, for both its existing condition and as an opportunity for an improved shop; and
  • Evidence is provided that there are alternative shops within a 400 metre walking distance.
