KBR14: MITIGATING THE IMPACT OF COMMERCIAL DEVELOPMENT

A: Non-residential development (all use classes excluding Class C) should be directed to the International Shopping Centre, and where consistent with Policy KBR25, the Strategic Cultural Area. Within the International Shopping Centre, proposals are expected to mitigate and reduce to a minimum their contribution towards the saturation effects being experienced within the area in terms of the impact of activities on the amenity of the existing community and other users.

B: Commercial development within the International Shopping Centre must demonstrate that it will not have a significant adverse impact on the following saturation effects, either individually or cumulatively, and will mitigate any associated impacts:

  • insufficient pavement space - caused by obstructions associated with uses in the area e.g. tables and chairs; and/or
  • traffic congestion, such as caused by the number of people visiting the premises or loitering in its vicinity or the servicing of commercial premises including convenience retail stores, and its environmental impacts; and/or
  • litter, rubbish, waste and dirty pavements. Uses which serve hot or cold food and drink to take away must ensure the provision of adequate refuse disposal points within or near the premises without creating an obstruction on the pavement.

C: The intensification of retail (Class A) or entertainment uses outside of the International Shopping Centre or Strategic Cultural Area must demonstrate no adverse impact on residential amenity. Where appropriate, mitigation measures that address the matters will be dealt with by way of planning conditions.
